Following are the definitions in codified laws that pertain directly or indirectly to South Dakota Road Districts.

SDCL 2-14-4 Application of statutory definitions.

Whenever the meaning of a word or phrase is defined in any statute such definition is applicable to the same word or phrase wherever it occurs except where a contrary intention plainly appears.


SDCL 22-1-2 Definitions

(18) “Government,” the United States, any state, county, municipality, school district, or other political unit, or any department, agency, or subdivision of any of the foregoing, or any corporation or other association carrying out the functions of any of the foregoing;

(38) “Public office,” the position held by a public officer or employee;

(39) “Public officer,” any person who holds a position in the state government or in any of its political subdivisions, by election or appointment, for a definite period, whose duties are fixed by law, and who is invested with some portion of the sovereign functions of government;


SDCL 3-1-10. Definitions.

The terms “office,” “officer,” “executive,” and “administrative,” when used in ยง 3-1-8 or 3-1-9 mean and apply to any executive or administrative officer of the state; to any county, municipality, township, or school district; and to any district, board, bureau, commission, department, or other body or office, exercising executive or administrative powers as part of the government, or any arm of the government, of the state. The terms “executive” and “administrative” apply interchangeably to any or all of said offices.


1-25-12. Definitions.

Terms used in this chapter mean:

(1)    “Political subdivision,” any association, authority, board, commission, committee, council, task force, school district, county, city, town, township, or other local government entity that is created or appointed by statute, ordinance, or resolution and is vested with the authority to exercise any sovereign power derived from state law;

(2)    “Public body,” any political subdivision and the state;

(3)    “Official meeting,” any meeting of a quorum of a public body at which official business or public policy of that public body is discussed or decided by the public body, whether in person or by means of teleconference;

(4)    “Teleconference,” information exchanged by any audio, video, or electronic medium, including the internet;

(5)    “State,” each board, commission, department, or agency of the State of South Dakota. The term, state, does not include the Legislature.


10-6-102. Mill levy defined–Substitution.

The term, mill levy, wherever it is used in this code means “tax levy.” The code commission in future supplements and revisions of the South Dakota Codified Laws is directed to substitute the term, tax levy, and derivatives thereof for the term, mill levy, and its derivatives.
